Gunnison adopts updates to nonconforming use regulations

The Gunnison City Council adopted Ordinance No. 6, Series 2026 updating the Land Development Code (LDC) regulations around nonconforming uses at its Oct. 13 meeting.

The updates were previously discussed at the Sept. 22 city council meeting, where much of the discussion focused on the expansion of nonconforming industrial uses and nonconforming signs.

Senior Plannier Andie Ruggera explained to the council that there were some items added to the changes to clarify issues from the previous discussion, including language that would bar the expansion of a nonconforming use of land related to the nonconforming use of a permanent structure.

She said that this would prevent expansion of things such as outdoor storage or storage of asphalt.

Ruggera also said that clarifications were made to the language concerning nonconforming signs. Some council members raised concerns at the previous meeting that the updated language could lead to issues with residents discontinuing using their nonconforming sign to repair or replace it and then not being allowed to use the updated sign since this activity might lead to the nonconforming use being discontinued.

Ruggera said that a subsection was added on the repair and maintenance of signs and the language on discontinuance of sign usage was reworded to make it clearer and give more flexibility on time frames for discontinuing use.

“You guys did a great job answering the questions and making the adjustments necessary, so thank you very much for that,” said Mayor Diego Plata.

Councilor Loren Ahonen also said that the changes addressed his questions.

“I appreciate staff’s work to take our feedback into account and polish up the document,” said Councilor Matt Schwartz.

The council then unanimously voted to adopt the ordinance.
