‘Nonconforming’ uses central to reason for granting appeal

In a rare move, Gunnison County Commissioners are poised to overturn a Planning Commission decision on a controversial proposal to headquarter a trash service company west of Gunnison.

Two of three commissioners determined last Thursday that county staff did not supply Planning Commission with adequate analysis to make a thorough decision regarding “legal nonconforming uses,” as defined in the county’s Land Use Resolution (LUR). Additionally, commissioners said they did not want to set a precedent by establishing a commercial operation in a rural residential neighborhood.
