SERIES 2010 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GUNNISON, COLORADO, VACATING THAT PORTION OF SOUTH 14TH STREET BETWEEN THE SOUTH LINE OF EVANS AVENUE, EXTENDED, AND THE NORTH LINE OF BIDWELL AVENUE, EXTENDED, ORIGINALLY DEDICATED BY THE OFFICIAL AMENDED PLAT OF TOWN OF WEST GUNNISON, CITY OF GUNNISON, STATE OF COLORADO; AND APPROVING AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF GUNNISON AND THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF GUNNISON FOR THE EXTENSION OF PUBLIC INFRASTRUCTURE IMPROVEMENTS. WHEREAS, the applicant, the Board of County Commissioners of the County of Gunnison, State of Colorado, submitted an application for vacating public property dated October 26, 2009, requesting the City of Gunnison to vacate that portion of South 14th Street between the south line of Evans Avenue, extended, and the north line of Bidwell Avenue, extended, all as originally dedicated in the official amended plat of West Gunnison, City of Gunnison; and WHEREAS, the Planning and Zoning Commission of the City of Gunnison held a public hearing upon the proposed vacation on December 9, 2009, and has made a recommendation to the City Council that the City Council proceed with the requested street vacation, with certain conditions regarding the extension of public infrastructure; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GUNNISON, COLORADO, ORDAINS THAT: Section 1. Findings of Fact. Based upon the application for street vacation, the supporting materials submitted therewith, and the evidence adduced at the public hearing conducted by the Planning and Zoning Commission of the City of Gunnison, the City Council hereby finds as follows: a. That the applicant, the Board of County Commissioners of the County of Gunnison, Colorado, is the owner of all the real property which is adjacent to that portion of the street requested to be vacated. b. That the Board of County Commissioners of the County of Gunnison, Colorado, has decided to locate a new criminal justice detention facility upon County-owned property adjacent to the requested street vacation, and that the additional land provided by the requested street vacation would be useful in the design and construction of such facility. c. That no properties, other than those of the applicant, would be denied access by the proposed street vacation. d. That the Building Official, Fire Marshal, and Chief of Police have no objection to the proposed vacation. e. That the City Engineer and the Public Works Department have suggested that the vacation be conditioned upon the extension of water mains and City streets in the vicinity of the requested street vacation in order to complete the public infrastructure requirements. f. That while members of the public object to the location of the criminal justice detention facility at this location, the City Council finds that the granting or denial of this vacation will not affect the decision of the Board of County Commissioners of the County of Gunnison, Colorado, to locate the proposed criminal justice detention facility at this location. g. That the proposed vacation will have little or no effect upon the contiguity or connectivity for street patterns within this neighborhood and is not in conflict with the City's Master Plan. Section 2. Vacation. The street which is vacated by this ordinance is that portion of South 14th Street lying between the south line of Evans Avenue, extended, and the north line of Bidwell Avenue, extended, all as originally dedicated in the official amended plat of West Gunnison, City of Gunnison, State of Colorado. Section 3. Public Infrastructure Extension. Concurrent with the adoption of this ordinance, the City Council of the City of Gunnison hereby approves the Intergovernmental Infrastructure Extension Agreement between the City of Gunnison and the Board of County Commissioners of the County of Gunnison, the execution of which by the parties thereto is made a condition of this vacation. The Mayor and City Clerk are hereby authorized to execute said agreement on behalf of the City of Gunnison. Section 4. Title. The title to such vacated street shall vest in accordance with the provisions of C.R.S. 43-2-302. A Letter of Interest/Qualifications from Interested Architectural Firms shall be submitted to Project One Integrated Services not later than the date and time stated below. All qualified responses received by the stated date and time shall be reviewed by the Owner and Owner's Representative and from these responses a shortlist of firms shall be created. The shortlisted firms shall receive a subsequent Request for Proposal ("RFP") to provide architectural, programming, design and construction administration services (the "Work") on the referenced projects. This solicitation of Letters of Interest is made on behalf of the Owner pursuant to the authority vested in the County Manager of Gunnison County, Colorado. (See www.gunnisoncounty.org) PROJECT DESCRIPTION, APPROACH AND SCHEDULE: The project will be comprised of a new, state-of-the-art County Jail facility and a separate Public Works building facility, with related site development, both facilities to be programmed and designed by one architectural firm, to be commissioned under one contract agreement to be executed between the Owner and selected architect for the work. Funding for the project is in process via forthcoming sale of Certificates of Participation, and the project is fully approved by the County Commissioners to commence design, pending bond sale funding and construction. Jail Facility: The anticipated size of the new County Jail is a 96 inmate bed, approximately 28,500 square feet complex, potentially to include provisions for an additional 5,000 square foot communications center in the jail, dependent upon budgetary considerations. The communications component will not be a part of the original project scope which will serve as the basis for this solicitation. Public Works Building: The anticipated size of the Public Works Building (PW) is approximately 38,500 square feet on a 15 acre site and includes vehicle maintenance, shops, equipment storage, administration and training space. Project Cost: The total construction cost for the Jail and PW facilities including site development and utility extensions, etc., is projected to be approximately $12 to $15 million dollars total. Project Approach: The successful Architectural team will work with the Owner's team to develop the Programming and Schematic design for each building. At the completion of the Schematic Design, the Architect will assist the Owner with a qualification and fee based selection process for a single General Contractor to join the team through a Construction Manager/General Contractor format under a Guaranteed Maximum Price delivery method for both projects. Word Fixes
As God tells us in I Thessalonians 2:12, he would have us walk worthy according to his word, "That ye would walk worthy of God, who hath called you unto his kingdom and glory." Walking worthy brings us the benefits he has promised and brings him the honor he deserves. Colossians 1:10 "That ye might walk worthy of the Lord unto all pleasing, being fruitful in every good work, and increasing in the knowledge of God;" Walking worthy is being in fellowship, it takes our whole heart, our desire to please God in our daily lives and relationships with others. As the previous verse says, being fruitful in every good work. He wants us to study his word, act on it and be fruitful in our works. His benefits are always there for us. He also provided discipline like any good father would do for his children. Hebrews 12:6 "For whom the Lord loveth he chasteneth, and scourgeth every son whom he receiveth." We are not without a book of directions that's for sure! Jo Laird |
